James M. Treppa and Holly A. Graves of Bledsoe, Diestel, Treppa & Crane LLP in San Francisco obtained a defense verdict for their clients in Contra Costa County Superior Court, the Honorable Danielle Douglas presiding.
Plaintiffs alleged a negligence cause of action against defendants stemming from a motor vehicle collision occurring on July 15, 2015. Plaintiffs alleged defendants negligently operated their vehicle causing the accident and plaintiffs’ personal injury. Defendants denied liability for the accident and asserted plaintiff’s own conduct caused the subject accident which was confirmed when it was determined through verifiable data that plaintiff ran the stop sign at the intersection just prior to the subject accident. The data from plaintiff’s vehicle also revealed an unexplainable wheel turn which defendants contended was an indication of inattention while operating her vehicle.
Plaintiff alleged the subject accident caused a severe traumatic brain injury which prevented her from performing her medical professional duties and her home and family duties at the same capacity as prior to the incident. Plaintiffs sought significant past wage loss and future loss of earning capacity and requested a verdict in the amount of $6.7 million. The jury deliberated for approximately 7 hours and returned a defense verdict.
