After a 15 day jury trial, partner Jeffrey V. Ta obtained a defense verdict in a negligence/premises liability case. Plaintiff, a 52 year old woman, was employed as a door-to-door salesperson and claimed she fell descending a flight of stairs while making a sales call on Defendant’s property. Plaintiff alleged the accident aggravated her pre-existing low back condition and required her to undergo a triple fusion spine surgery and replacement of both hips. The defense argued the accident did not aggravate Plaintiff’s pre-existing condition and she would have needed the surgeries even if the accident had not occurred. Prior to trial, Plaintiff rejected a $500,000 settlement offer. At trial, Plaintiff asked the jury for a $6,000,000 verdict.
